It is not always all that clear when someone is inebriated when they leave a bar since all one has to be able to do is get out of ones chair and walk out the door without drawing attention. Also if one is taking medication like heart medication it may heighten the effects of alcohol so one doesn't have to drink all that much to become inebriated. And lastly try telling your boss he is too drunk to drive in front of other people or in a public place. It isn't easy.
